Welcome to Kesha Wright Photography (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, www.keshawrightphotography.com (“Website”), and all related services provided by Kesha Wright Photography (“Services”).

By using our Website or booking our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.

1. Services Provided

Kesha Wright Photography offers premium photography services, including but not limited to:
 • Intimate Weddings & Elopements
 • Portrait Photography (families, seniors, headshots)
 • Branding Photography (entrepreneurs, creatives, and small businesses)
 • Event Photography (private events, corporate functions, and experiential events)

Our services are designed to provide authentic, high-quality, and personalized photography experiences.

2. Booking and Payment

2.1 Booking Process

To book a session, clients may inquire via the Website, email, or other communication channels. Bookings are confirmed upon receipt of a signed contract and a non-refundable retainer. All bookings are subject to availability.

2.2 Payment Terms
 • A non-refundable retainer is required to secure your session or event date.
 • The remaining balance is due before the session or event, as outlined in your contract.
 • Accepted payment methods will be communicated during the booking process.
 • Failure to complete payments on time may result in the cancellation of your booking.

2.3 Refunds and Cancellations
 • Retainers are non-refundable unless Kesha Wright Photography cancels the session.
 • Clients must provide at least 7 days’ notice for cancellations or rescheduling.
 • Cancellations made after this period may result in the forfeiture of payments made.

3. Client Responsibilities

Clients agree to:
 • Provide accurate and timely information regarding session details and preferences.
 • Secure necessary permissions, permits, or location fees for photography.
 • Arrive on time for sessions. Delays may reduce session time without refund.

Kesha Wright Photography is not responsible for missed moments or specific images if clients fail to provide necessary details or are uncooperative during the session.

4. Image Rights and Usage

4.1 Client Use

Upon full payment, clients receive a license to use the final edited images for personal, non-commercial use, including sharing on social media and printing. Photo credit to Kesha Wright Photography is appreciated but not required.

4.2 Commercial Use

Commercial use of images (e.g., for business marketing, advertisements, or product sales) requires a separate commercial licensing agreement and may incur additional fees.

4.3 Photographer Rights

Kesha Wright Photography retains the copyright to all images. We reserve the right to use images for promotional purposes, including but not limited to our portfolio, website, social media, and marketing materials.

Clients preferring privacy must provide written notice at the time of booking.

5. Turnaround Time and Delivery
 • Portrait and Branding Sessions: Final images are delivered within 2–3 weeks.
 • Weddings and Events: Final images are delivered within 6–8 weeks.
 • Sneak Peeks: Available within 72 hours of the session or event.

Images are delivered via a secure online gallery. The client is responsible for downloading and backing up images. Galleries may be archived after a specified time, as noted in the contract.

6. Quality Assurance and Revisions

Kesha Wright Photography delivers professionally edited images that reflect our artistic style.
 • Minor edits (color correction, lighting adjustments) are included.
 • Requests for extensive retouching or additional edits may incur extra fees.
 • Concerns must be raised within 7 days of receiving the gallery.

7. Limitation of Liability

Photography is a creative service, and while we strive for excellence, we cannot guarantee specific results.

Kesha Wright Photography is not liable for:
 • Missed moments due to client tardiness or interference.
 • Damages caused by circumstances beyond our control (weather, venue restrictions).
 • Any loss, theft, or damage to delivered digital files once provided.

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages related to our Services.

8. Force Majeure

We are not responsible for delays or cancellations due to causes beyond our control, including but not limited to:
 • Natural disasters
 • Pandemics or public health emergencies
 • Governmental actions
 • Acts of terrorism or war

In such cases, deposits may be transferred to a rescheduled date but are otherwise non-refundable.

9. Modifications to Services and Terms

Kesha Wright Photography may update, modify, or discontinue any aspect of our Services or Website at any time without prior notice.

We reserve the right to update these Terms of Service. The latest version will always be available on the Website. Continued use of our Services after changes are made indicates your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Chicago, Illinois.
